The Beautiful House, LLC (together with each of its subsidiaries and affiliates, "Company," "we," or "us") respects your privacy. This Privacy Notice describes the types of information we may collect from you when you visit all Company-owned physical locations, websites and domains, including CasaBonitaDenver.com or use our other services that include an authorized link to this Privacy Notice (collectively, the "Offerings"). This Privacy Notice describes (i) how we use the information we collect, (ii) with whom we share it, (iii) how we protect it, and (iv) the choices we offer you regarding our collection and use of such information.

1. Personal Information We Collect and How We Collect It

What We Collect. The personal information we collect about you may include, without limitation:

  • Contact information, such as name, postal address, email address, and phone number;
  • Demographic information, such as age, date of birth, and postal code;
  • Profile information when you choose to join The Founder’s Club, such as name, TFC ID number, reservation details, used and unused benefits; and
  • Payment and financial details, such as payment card number, expiration date, authentication code, billing address, and bank account number, the average value of your order via the Offerings.

How We Collect It. We may collect personal information about you, meaning information that can uniquely identify you, from various sources, such as:

  • Directly from you when you use the Offerings, such as when you sign up for our Founders Club or other programs that we offer, make a reservation, access certain features or content, or order products;
  • Social networks through which you may access the Offerings or otherwise interact with us; and
  • Our partners, subsidiaries, affiliates, service providers, business partners, and other third parties.

Automatic Collection. To the extent permitted by applicable law, and, where required, with your express consent, when you use the Offerings, we may also collect certain information by automated means, such as cookies. A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. We may, to the extent permitted by applicable law, also use third-party analytics tools (such as Google Analytics) that collect information about use of the Offerings and user traffic. The information we collect by automated means may include, without limitation:

  • Information about the devices you use to access the Offerings (such as the IP address and the type of the device, operating system, and web browser);
  • Dates, times, and duration of use of the Offerings (including whether you are a repeat or first-time visitor, the frequency of your visits, the date of your first visit); and
  • Information on actions taken when using the Offerings (such as page views and website navigation patterns).

The information we collect automatically (to the extent permitted by applicable law, and, where required, with your express consent), is statistical data and may include personal information. It helps us to improve and personalize our Offerings, including by enabling us to identify and authenticate users.

2. Cookies and Other Tracking Technologies

To the extent permitted by applicable law, and, where required, with your express consent, we and our providers use cookies, pixel tags, and other similar tracking technologies to automatically collect information about browsing activity, device type, and similar information within the Offerings. This information, which may be considered personal information in some jurisdictions, is used, for example, to analyze and understand how you access, use, and interact with our website; to identify and resolve bugs and errors on our website; to assess, secure, protect, optimize, and improve the performance of the Offerings; and for marketing, advertising, measurement and analytics purposes. We may, to the extent permitted by applicable law, also de-identify and/or aggregate such information to analyze trends, administer the Offerings, and gather broad demographic information for aggregate uses, and for any other lawful purposes.

Cookies Cookies are alphanumeric identifiers used for tracking purposes. Some cookies allow us to make it easier for you to navigate our Offerings, while others are used to enable a faster log-in process, to support the security and performance of the Offerings, or to allow us to track activity and usage data within and across our Offerings.

Pixel Tags and Similar Technologies. Pixel tags (sometime called web beacons or clear GIFs) are tiny graphics with a unique identifier, similar in function to cookies. We may use these tracking technologies to understand users’ activities, to help manage content and compile usage statistics, and in emails to let us know when they have been opened or forwarded so we can track response rates and gauge the effectiveness of our communications.

Local storage objects. Local storage is a web storage mechanism that allows us to store data on a browser that persists even after the browser window is closed. Local storage may be used by our web servers to cache certain information in order enable faster loading of pages and content when you return to the Offerings. You can clear data stored in local storage through your browser. Please consult your browser help menu for more information.

Analytics. We use analytics tools, such as Google Analytics, to evaluate usage and traffic of the Offerings. These analytics providers use cookies, pixels, and other tracking technologies to collect usage data to provide us with reports and metrics that help us analyze, improve, and enhance performance and user experience. You can learn more about how Google uses your information at google.com/policies/privacy/partners/ ("How Google uses information from sites or apps that use our services"). You can also download the Google Analytics Opt-out Browser Add-on to prevent your information from being used by Google Analytics at tools.google.com/dlpage/gaoptout.

Cross-Device Tracking. We and ad networks we work with may use the information we collect about you within the Offerings, and on other third-party websites and services, to help us and these third parties identify other devices that you use (e.g., a mobile phone, tablet, other computer, etc.) to interact or engage with us through the Offerings.

Advertising Networks. We work with ad networks, channel partners, mobile ad networks, analytics and measurement services, and others ("ad networks") to personalize content and display advertising within our Services, as well as to manage our advertising on third-party websites, mobile apps, and online services. We may share certain information with ad networks, and we may each use cookies, pixels tags, and other tools to collect usage and browsing information within our Services, as well as on third-party websites, apps, and services. This information may include IP address, location information, cookie and advertising IDs, and other identifiers, as well as browsing information.

"Do Not Track" Signals. A do not track signal ("DNT") prevents web applications from tracking you, you can learn more about DNT at https://allaboutdnt.com. Currently, our website does not recognize web browser "Do-Not-Track" requests. You may, however, disable certain tracking as discussed below (e.g., by disabling cookies).

3. How We Use the Personal Information We Collect

We may use information we obtain about you to:

  • Process orders you place and complete other transactions you have requested using the Offerings, and provide you with products and services you request;
  • Send you information or materials you request;
  • Maintain a record of your purchases and other transactions using the Offerings;
  • Respond to your questions and comments and provide customer support;
  • Communicate with you about our products, services, offers, and promotions;
  • Administer any loyalty or rewards program that we may offer from time to time;
  • Operate, evaluate, and improve our business and the products and services we offer;
  • Analyze and enhance our marketing communications and strategies (e.g., we may use your name, email, unique identifiers, device and browsing information, and Offerings activity and usage information to manage and improve our advertising campaigns so that we can better reach individuals with relevant content, including through targeted advertising);
  • Analyze trends and statistics regarding use of the Offerings and transactions conducted using the Offerings;
  • Protect against and prevent fraud, unauthorized transactions, claims, and other liabilities, and manage risk exposure, including by identifying potential hackers and other unauthorized users;
  • Enforce our Terms of Use and other agreements; and
  • Comply with applicable legal requirements and industry standards.

Other Uses. We also may use the information we obtain about you in other ways for which we provide specific notice at the time of collection and, where required by applicable law, with your consent.

4. Disclosure of Personal Information

Who We Disclose To. To the extent permitted by applicable law, and, where required, with your express consent, we may disclose aggregated information about our users, and information that does not identify any individual user, without restriction. We may disclose personal information about you:

  • To contractors, service providers (including IT service providers, cloud service providers, logistics services providers (to process orders), and other parties we use to support our business in accordance with the principles of this Privacy Notice;
  • To our affiliates or subsidiaries who will use and disclose this personal information in accordance with the principles of this Privacy Notice.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • To enforce or apply our Terms of Use and other agreements;
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Company, users of the Offerings, or others;
  • To third parties to market their products or services to you if you have not opted out of these disclosures;
  • To advertising platforms, providers and networks in support of our marketing, advertising, and campaign management.
  • To the extent permitted by applicable law, if we, our affiliates, or subsidiaries are or may be acquired by, merged with, financed by, or invested in by another company, or if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected about you to the other company. We may also share certain personal information as necessary prior to the completion of such a transaction or corporate transactions such as financings or restructurings, to lenders, auditors, and other advisors, including attorneys and consultants, as part of due diligence or as necessary to plan for a transaction; and
  • To other third parties, with your consent.

5. Retention of Personal Information

We will keep your personal information for as long as it necessary to provide the Offerings to you. Thereafter, to the extent permitted by applicable law, we will keep your personal information unless and until you exercise your rights of deletion in Section 7 below, at which time your data will be deleted, deidentified, or overwritten with random data.

6. Data Security.

We have implemented measures intended to protect your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. Please note, however, that the electronic transmission of information is not completely secure. We cannot guarantee that the security measures we have in place to safeguard personal information will never be defeated or fail, or that such measures will always be sufficient or effective. Any transmission of personal information is at your own risk.

7. Your Privacy Choices.

We offer you the following choices about the information we collect from you and how we communicate with you:

  • Cookies. You can set your browser to block certain cookies or notify you when a cookie is set; you can also delete cookies. The “Help” portion of the toolbar on most browsers will tell you how to prevent your device from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to delete cookies. Visitors to the Offerings who disable cookies will be able to browse the website, but some features may not function. If you visit the Offerings from a different device or from a different browser on the same device, you will need to apply your cookie settings for that browser and/or device as well. The cookie preference manger may be accessed in the footer under "privacy settings".
  • Promotional Emails. Other than to the extent prior consent is required by applicable law, if you do not want us to use your email contact information to promote our products or services, you can opt out by checking the relevant box located on the form on which we collect such information or at any other time by sending us an email stating your request to info@casabonitadenver.com. If you have received a promotional email from us, you can also opt out of receiving future promotional emails from us by following the unsubscribe instructions contained in such email.
  • Promotional Text Messages. If you have opted into receiving promotional text messages from us, you may opt out at any time by replying “STOP” to any message.
  • Disclosure of Personal Information for Third-Party Advertising. Other than to the extent prior consent is not required by applicable law, if you do not want us to share your personal information with third parties for their own promotional purposes, you can opt out by emailing us at info@casabonitadenver.com.
  • Industry Ad Choice Programs. You can also control how participating ad networks use the information that they collect about your visits to our Site and Services and those of third parties, in order to display more relevant targeted advertising to you. You can obtain more information and opt out of receiving targeted ads from participating ad networks at https://aboutads.info/choices (Digital Advertising Alliance).
  • Accessing, Correcting, and Deleting Your Personal Information. You may send us an email at hola@casabonitadenver.com to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
  • The Founders Club. If you created a profile as a member of The Founders Club, you can update your profile information by logging into your account.

8. Children Under the Age of 13.

The Offerings are not directed to, and we do not knowingly collect or solicit personal information from, children under the age of 13. If we learn we have collected or received personal information from a child under the age of 13, we will delete that information. If you believe we might have any information from or about a child under the age of 13, please contact us at info@casabonitadenver.com.

9. Changes to Our Privacy Notice.

We reserve the right to update or change this Privacy Notice at any time. If we make a material change to our Privacy Notice, we will provide notice to you (for example, by email and/or posting on our website) that our privacy practices have changed and will provide a link to the new policy. Where required by applicable law, we may need to ask you to confirm your consent to the processing of your personal information. Otherwise, your continued access to or use of our Offerings constitutes your acknowledgment and acceptance of any such changes. The date this Privacy Notice was last revised is at the top of this page. We encourage you to review this Privacy Notice periodically to check for any updates or changes.

10. Third Party Links

The Offerings may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Privacy Notice, but instead is governed by the privacy notices of those third-party websites. We are not responsible for the information practices of such third-party websites.

11. Data Transfers

We are based in the United States. When we obtain information about you, we may transfer, process, and store such information outside of the country in which you reside, including in the United States. By using the Offerings, you consent to the transfer to and processing and storage of your information in countries outside of your country of residence, which may have different data protection laws than those in the country where you reside.

13. Additional Privacy Information for Certain United States Residents

Residents of Colorado have additional rights under the Colorado Privacy Act,Residents of certain U.S. states, including Colorado, require additional disclosures under applicable privacy laws.

Sale of Personal Information. We do not sell personal information about users to any third party for monetary consideration; however, we may “sell” (as such term is defined under the Colorado Privacy Act) identifiers; commercial information; location information (via your IP address); and internet and network activity information with third-party advertising networks, affiliates, analytics providers, and social networks for purposes of marketing and advertising and to improve and measure our ad campaigns, which may constitute a “sale” in certain jurisdictions. We do so in order to improve and evaluate our advertising campaigns and better reach customers and prospective customers with more relevant ads and content.

Residents of Colorado have additional rights under the Colorado Privacy Act, subject to certain limitations, which may include:

  • Correction. The right to correct inaccuracies in their personal information, taking into account the nature and purposes of the processing of the personal information.
  • Deletion. To delete their personal information provided to or obtained by us.
  • Access: to confirm whether we are processing their personal information and to obtain a copy of their personal information in a portable and, to the extent technically feasible, readily usable format.
  • Opt out: to opt out of certain types of processing, including:
    • to opt out of the “sale” of their personal information.
    • to opt out of our use of targeted advertising.
    • to opt out of any processing of personal information for purposes of making decisions that produce legal or similarly significant effects.

You may submit a request to exercise most of your privacy rights under the Colorado Privacy Act through our webform or by emailing us at hola@casabonitadenver.com. When you submit a request, we will take steps to verify your identity and your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for denial and how to remedy any deficiencies, where applicable.

If we deny your request, you may appeal our decision by accessing this form https://www.casabonitadenver.com/contact. We will respond to your appeal with an explanation about our decision to fulfill or refuse your appeal. If we deny your appeal, you may contact the Colorado Attorney General if you wish to file a complaint related to the denial.

Authorized agents may initiate an opt-out request on behalf of another individual by contacting us at info@casabonitadenver.com; authorized agents will be required to provide proof of their authorization and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.

To opt out of targeted advertising via the use of your online personal information, you can set your browser to block targeting cookies or notify you when a cookie is set; you can also delete cookies. The “Help” portion of the toolbar on most browsers will tell you how to prevent your device from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to delete cookies. Sources of Personal Information. In general, we may collect the categories of personal information identified in the table above from the following categories of sources: directly from the individual, our affiliates and subsidiaries, data analytics providers, social networks, and advertising networks.

Sales and Sharing of Personal Information. The CCPA defines “sale” as disclosing or making available personal information to a third party in exchange for monetary or other valuable consideration, and “sharing” includes disclosing or making available personal information to a third party for purposes of cross-contextual behavioral advertising. While we do not disclose personal information to third parties in exchange for monetary compensation, we may “sell” or “share” the following categories of personal information: identifiers; commercial information; location information (via your IP address); and internet and network activity information. We may disclose these categories to third-party advertising networks, affiliates, analytics providers, and social networks for purposes of marketing and advertising and to improve and measure our ad campaigns.

We do not sell or share any sensitive personal information about California residents. Nor do we sell or share any personal information about individuals who we know are under sixteen (16) years old.

Purposes of Collection, Use, and Disclosure. As further described under Section 3, “How We Use the Information We Collect” and Section 4, “Disclosure of Personal Information,” we collect, use, disclose, and otherwise process the above personal information for the following business or commercial purposes and as otherwise directed or consented to by you:

  • To provide the product or service requested and to process orders you place;
  • To send you information or materials requested;
  • To maintain records of your purchases and other transactions;
  • To communicate with you about our products, services, offers, and promotions;
  • Administer any loyalty or rewards program that we may offer from time to time;
  • To operate, evaluate, and improve our business and the products/services we offer;
  • To analyze and enhance our marketing strategies;
  • To analyze the use of our products and services;
  • To protect against misuse of our products/services and to manage our risk exposure;
  • To secure and protect our rights;
  • To comply with legal proceedings and obligations; and
  • For general business and operational support.

Sensitive Personal Information. We do not collect, use, or disclose “sensitive personal information” beyond the purposes authorized by the CCPA. Accordingly, we only use and disclose sensitive personal information as reasonably necessary and proportionate: (i) to perform our Offerings requested by you; (ii) to help ensure security and integrity, including to prevent, detect, and investigate security incidents; (iii) to detect, prevent and respond to malicious, fraudulent, deceptive, or illegal conduct; (iv) to verify or maintain the quality and safety of our Offerings; (v) for compliance with our legal obligations; (vi) to our service providers who perform services on our behalf; and (vii) for purposes other than inferring characteristics about you.

Retention. We retain the personal information we collect only as reasonably necessary for the purposes described above or otherwise disclosed to you at the time of collection and as otherwise necessary to comply with our legal obligations, resolve disputes, maintain appropriate business records, and enforce our agreements.

De-identified personal information. Notwithstanding anything else described in this Privacy Notice, we may use and disclose aggregate, deidentified, and other non-identifiable data related to our business and the services for quality control, analytics, research, development and other purposes. Where we use, disclose or process deidentified data (data that is no longer reasonably linked or linkable to an identified or identifiable natural person, household, or personal or household device) we will maintain and use the information in deidentified form and not to attempt to reidentify the information, except in order to determine whether our deidentification processes are reasonable and adequate pursuant to applicable privacy laws.

California Residents’ Rights. Under the CCPA, California residents have the following rights (subject to certain limitations):

  • To opt out of sales and sharing. The right to opt-out of our sale and sharing of their personal information.
  • To limit certain uses and disclosures of sensitive personal information. We do not collect, use, or disclose sensitive personal information beyond the purposes permitted under the CCPA; thus, this right is not available to you.
  • Deletion. The right to the deletion of their personal information that we have collected, subject to certain exceptions.
  • To know/access. The right to know what personal information we have collected about them, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about them.
  • Correction. The right to correct inaccurate personal information that we maintain about them.
  • Non-discrimination. The right not to be subject to discriminatory treatment for exercising their rights under the CCPA.

Submitting CCPA Requests. California residents may exercise their CCPA privacy rights as set forth below.

Request to know/access, correct, delete. California residents may submit CCPA requests to access/know, correct and delete their personal information maintained by us by submitting a consumer request through our webform here, or by calling 303-232-5115.

When you submit a request, we will take steps to verify your identity and your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for denial.

You may also designate someone as an authorized agent to submit requests and act on your behalf. Authorized agents will be required to provide proof of their authorization. We may require you to confirm that you have provided the authorized agent permission to submit the request and you must provide the authorized agent with permission. We may deny a request from an authorized agent who does not submit proof that he or she has been authorized to act on your behalf.
